Exterior Property Maintenance
The purpose of the Town of Greece Property Maintenance Law is to:
Preserve and improve Town appearance, quality of life, and citizen pride. Prevent the gradual encroachment of blight, deterioration, unsightliness, and property devaluation. Assure the safety, health, and welfare of the general public.
Areas Covered by the Property Maintenance Law
This law applies to all buildings and premises within the Town of Greece except publicly owned or controlled land. The ordinance applies to:
Vacant land and buildings. Residential one, two, and multiple family dwellings, mixed occupancy, storage, and accessory buildings. All buildings or land under construction or demolition.
General Exterior Property Maintenance
Lawns
All grass, weeds, or other plant growth must be cut or trimmed to avoid the development of places for the accumulation of blowing trash, dumping of trash or debris, rodent harborage or infestation, criminal activity, or places which constitute a blighting or unsightly influence on the neighborhood. Any trees, shrubs, hedges, and bushes, or portions thereof which are hazardous to persons or property must be trimmed or removed. Farms and open or wooded land are not required to be mowed.
Painting
Building exterior surfaces must be maintained in good condition. Surfaces not normally resistant to deterioration must be treated with a protective coating of paint or other suitable preservative.
Accessory Structures
Fences, walls, and other minor constructions must be maintained in a safe and substantial condition.
Property Access
Steps, walks, driveways, parking spaces, and similar paved areas must be maintained to allow safe and convenient passage.
Open Areas
Yards, courts, and vacant areas must be kept clean and free of hazards and refuse.
Garbage, Trash, and Junk
Accumulation of Garbage
The accumulation of garbage, trash or junk is not permitted except for normal weekly collection or when caused by construction or remodeling of a building or landscaping operations. Care must be taken to assure such accumulation isn’t unsightly and is removed immediately upon work completion or within a reasonable time after. Garbage and refuse must be placed in covered, watertight containers. Refuse may not be placed at the curb before 12:00 noon of the day preceding collection.
Definition
The definition of "junk" is any manufactured good, appliance, fixture, furniture, machinery, motor vehicle, recreational vehicle, trailer, or similar object which is abandoned, demolished, discarded, or generally unusable.
Garbage Collection
All premises are required to contract with a licensed garbage collection service.
Storage and Parking of Motor Vehicles
Storage
It is unlawful to store an unlicensed, wrecked, abandoned, or dismantled motor vehicle outdoors on any residential premises. (One motor vehicle which is driven for only part of the year may be issued a six (6) month storage permit by the Technical Services Department. The owner must be able to demonstrate that the vehicle is road worthy, and must be covered by a fitted commercial cover.) There are no restrictions on the garaging of any vehicles.
Parking
Motor vehicles and recreational vehicles may not be parked on the "tree lawn" or the area between the sidewalk and the curb except when the Town Winter Parking Ordinance is in effect between November 1 and April 15. Parking of motor vehicles may not interfere with the use of building exits, sidewalks, public rights of way, or adjoining premises. No vehicle may be stored in a public right of way.
Commercial Vehicles
One commercial vehicle of up to one (1) ton capacity may be parked at a residence.
Recreational Vehicles
Parking of recreational vehicles owned by a resident of the premises is permitted, provided that such vehicles are licensed and in condition for their intended use:

Signs
Type
Signs in residential districts are limited to election signs, garage sale signs, building or lot for sale or rent signs, signs for roadside stands for sale of produce grown on the premises, and signs for major home occupations. Garage sale and realtor signs are restricted to one (1) sign of six (6) square feet or less.
Location
Signs may NOT be:
Attached to fences, trees, or utility poles. Placed in the right of way (generally between the sidewalk and the curb). Placed to impair or obstruct the vision of motorists. Placed off the premises to which the sign refers.
Garage Sale Signs
Garage sale and other temporary signs must be removed within forty-eight (48) hours of the end of the event.

Building Address Numbers
Building numbers allow emergency vehicles to locate a dwelling quickly, and serve as well for the convenience of those trying to locate a building in non-emergency situations.
Address Numbers Must Be:
Securely mounted to a building’s front wall, entry-way from a public street, or main path leading to the main entrance from a public street. Arabic (1, 2, 3, etc. not script or Roman numerals). At least four (4) inches high in residential areas. Between four (4) and ten (10) feet above grade. Clearly visible from the street.
Pets
All pets must be kept in an appropriate manner and under control. Up to three (3) dogs will be permitted per dwelling, not counting offspring less than four (4) months old, of any resident female dog. Farm animals regardless of side, breed or species must be kept only on a farm. Other animals may be kept as pets indoors, except cats, which may be kept outside. Complaints about barking dogs or dogs running at large should be directed to the Town of Greece Animal Control (call 911).
Filling
Filling or the changing of established grades requires the approval of the Town Engineer and the Building Inspector. Filling may not obstruct natural or installed drainage. A permit may be required for filling. For information call the Town of Greece Engineering Department.
Zoning Violations
Please direct all inquiries regarding zoning violations to the Town of Greece, Technical Services Department.
Building Permits
Building permits are required for many common residential projects, including remodeling and conversions, additions, decks, fences, swimming pools and pool decks, gas appliances, and chimneys. Please contact the Town of Greece Technical Services Department for further information before starting your project.
Enforcement
Voluntary compliance is always preferred.
If a representative of the Technical Services Department determines that a building or premise is in violation of any code, rule, or regulation, notice will be made by either regular mail, personal service, or the posting of an order on the property. The notice will provide a specified number of days to comply. Failure to comply within the time specified, may result in the issuance of an official Notice and Order, and/or an Appearance Ticket for the Town Court. The Town may also have the necessary work performed to correct the violation(s) and bill the owner of the property for the cost of the work. Unpaid charges are added to the property tax bill.
Penalties
Any person convicted of a violation of the Property Maintenance Law may be punished by a fine of not more than one thousand dollars ($1,000) or by imprisonment not to exceed one (1) year, or both, for each violation. Each day that the violation continues constitutes a separate offense, and the penalties above are applicable to each offense.
Complaints
Any individual may anonymously register a complaint by visiting, writing, calling, or e-mailing the Constituent Services Department 225-2000. It is not necessary to provide identification. A Technical Services Department representative will conduct an on-site evaluation of the area in question to determine what action is warranted. (FAQ10774)

Please read the following explanation as to how to plead on your ticket and either drop it off at our office any time during office hours or send it to us by mail.
Pleading Guilty You can plead guilty by mail by following the instructions on the ticket and sending the signed form to Greece Town Court, 4 Vince Tofany Blvd, Rochester, NY 14612. Upon receiving the guilty plea a Judge will determine the fine and the court will notify you of the amount by mail.
You will be expected to send the fine to the court within 21 business days by bank draft or money order payable to Greece Town Court or by credit card (Visa or Master Card).

You have the option of requesting a supporting deposition which is a sworn statement from the ticketing officer that contains a more detailed explanation of the basis for the charge than is provided on the ticket. The supporting deposition is usually generated by the Officer at the time of the stop now that most tickets are being written electronically.
Upon receipt of your not guilty plea the court will schedule a new court date which you will receive by mail. At this time, you will talk to the town prosecutor about a disposition of your case. If a resolution has not been agreed to and the Officer is needed to commence a trial, your case will be adjourned to another date so that we can subpoena the police officer to testify.
A trial is the proceeding at which a judge will make a determination whether you are guilty or not guilty. At the trial the officer who issued the ticket will testify and you will have the opportunity to cross-examine him/her. Thereafter you and your witnesses if any will have the opportunity to testify. The town prosecutor can cross-examine your witnesses and you. When the testimony is completed the Judge will make a decision and will usually announce it in court at the trial. Who Can Obtain: Fund raising organizations who intend to raise money by holding Bingo games, Games of Chance, and in some cases Raffles, must apply for an identification number issued through the NYS Office of Racing and Wagering. All organizations must have an identification number. If your organization needs a number or has not used its number in the previous twelve-month period, you must update your information with Racing and Wagering:

If your organization is conducting Games of Chance (Casino Nights, Bazaars, Carnivals), etc., you must provide the following:
Provide three complete applications (Form GC-2) for each license. Forms available at www.racing.state.ny.us. It is wise to keep a copy for yourself. The head of the organization must sign three original applications, which must all be notarized.
Provide a current list of working members and their date of birth. To expedite processing, please only submit names of those that will be working at the events.
Gaming Laws require that there must be at least four (4) members in charge. When providing this information, keep in mind that anyone convicted of a crime cannot be listed on the application.

Prior to conducting Bingo games, the organization should submit three (3) original Bingo License Applications, including all schedules, with a check in the amount of $18.75 per occasion, to the Town Clerk's Office. The state code allows recreational fires if the fire is contained and is 25 feet from a structure or combustible material. The fire shall be consistently attended until extinguished. Methods for extinguishment such as fire extinguisher, dirt, sand, garden hose shall be available for immediate use. The county health department also regulates under the open burning regulations specifically "nuisance calls". If a person calls and complains (911) the fire department will respond and put the fire out. If this happens more than two times the fire department will refer to the Fire Marshal's Office. They will then forward the complaint to the Health Department for enforcement. It is important to note that smelling smoke does constitute a nuisance). Open Burning falls under both state and county codes. An example of open burning is a farm burning some old cut down trees. This event requires permits from the Fire Marshal's Office and approval from the Health Department.

- If you are convicted of a violation that occurred while your car was moving (e.g. speeding, failing to stop for a red light, failing to stop at a stop sign, etc.), points will be assigned to you based on a schedule adopted by the New York State legislature. If you accumulate three speeding violations or 11 points within an 18 month period, the Department of Motor Vehicles will suspend your license. If you accumulate 6 or more points within an 18 month period (which could result from just 1 conviction of 21 mph over the speed limit), you will have to pay NY State $100.00 per year for 3 years plus $25.00 for each additional point accumulated. The number of points attributed to various infractions are as follows.
How your point total is calculated:
You must be convicted of the traffic violation before points are added to your driving record.
Your point total is calculated based on the date of violation, not the date of conviction.

If the resident rejects the mailbox offered, the Town of Greece will reimburse the resident up to $35 upon submission of original receipt as proof of purchase.
Contact the Department of Public Works at 225-4590 to report a damaged mailbox and please specify at that time if you would like the town to replace the mailbox/post with our in-stock materials or if you would instead prefer to request the up to $35 voucher to reimburse your own purchase and installation of a new mailbox/post. Make sure that you obtain the Eviction Guide which is intended to provide general information for landlords who must pursue an eviction procedure. Specific problems may require a consultation of a lawyer. Court staff can not give you any legal advice.
Service of Papers: The papers must be served between five (5) and twelve (12) days before the date to appear in Court. RAPL 733(1).
The notice of petition, petition to recover, and affidavit of service must be filed with the Court within three (3) days of personal service or mailing depending on which method of Service is used. RAPL 735(2).
If substituted service is used, the required papers must be filed at least five (5) days before the date to appear in Court. RAPL 735(2), 733(1). (When substituted service is used, the papers are not considered served until they are filed with the court).
Failure to follow these procedures properly requires the court to dismiss the proceeding for lack of jurisdiction (see Garrison v. Abrams, 57 Misc.2d 417, (1965).
When you appear in court, please bring the warrant of eviction and judgement paperwork to court with you so that the Judge can sign them for you before you leave the court room. Please make sure that all forms are filled out correctly. The Judge can not fill out the paperwork for you.

Sewer Laterals – Residential laterals are inspected by Department of Public Works personnel before covering. Commercial laterals are inspected by the Technical Services Department. This is a visual inspection of the pipe between the right of way and the building foundation. Residential laterals between the right of way and the main sewer are rodded by the inspectors at this time.
Water Service Lines – Residential water lines are inspected by Department of Public Works personnel before covering. Commercial laterals are inspected by Technical Services. As indicated with the permit, this is a visual inspection of the water line from the right of way line or water main, to the foundation.
Footings – Are inspected by the Technical Services Department before concrete is poured.
Soil Bearing Certification – Certification of soil condition by a licensed professional engineer prior to pouring of footings, in accordance with generally accepted engineering practices.
Concrete Foundation Certification – Prepared by a licensed professional architect or engineer prior to the erection of above grade walls.
Foundations – Inspected by Technical Services after waterproofing is applied and before backfill. Inspection of the foundation penetration of sewer laterals, water lines, and/or foundation drains is also done at this time.
Foundation Certification – Made by a licensed professional architect or engineer, prior to above grade construction.
F.E.M.A. Elevation Certificate – Made by a licensed professional at the completion of a foundation for buildings located in federally identified flood plains. This type of certification is to be made on the proper Federal Emergency Management Agency form, available from your surveyor, and must be reviewed and accepted by the Town of Greece prior to above grade construction.
Local Elevation Certificate – For buildings our of a flood plain requiring elevation certificates. May be made in the form of a letter, map, or similar document and must be reviewed and accepted by the Town prior to above grade construction.
Underground Plumbing – Inspections are performed by the Technical Services Department before covering underslab plumbing and foundation drains.
Pre-Insulation Inspection – Performed by the Technical Services Department when rough framing, rough heating, and rough plumbing installations are complete.
Rough Framing Inspections – Are performed by the Technical Services Department when all structural components of a building have been installed in conformance with the approved plans. Framing inspection for single family residential structures or additions is completed during the pre-insulation inspection.
Structural Steel Certification – Is the “as built” certification completed by a licensed professional that a building complies in all respect with codes, generally accepted standards, and the approved plans.
Tenant Separations – Are inspected by the Technical Services Department before ceiling installation. This is a visual inspection to confirm the tenant separation integrity.
Rated Separations – Are inspected by the Technical Services Department before ceiling installation and after the installation of mechanicals.
Rough Plumbing Inspections – Are performed by the Technical Services Department before covering. We recommend that these inspections be requested by the licensed plumber performing the plumbing work. Many plumbing installations (particularly commercial and industrial) require multiple inspections.
Plumber’s Wet Test Certification – Is a written certification submitted by a licensed plumber stating that a wet test has been completed. Forms are available at the Technical Services Department.
Gas System Certification – Is completed by the installer on a form supplied by the Technical Services Department stating that the piping was installed and tested in conformance with the provisions of the applicable codes, rules, and regulations.
Rough Heat Inspections – Are performed by the Technical Services Department of all duct work, before covering.
Masonry Fireplace Inspections – Are performed by the Technical Services Department at the time of the placement of the first flue and on completion of fireplace (ref. To Solid Fuel Burning Appliances & Chimneys).
Gas Fireplaces – Are inspected by the Technical Services Department before chase is enclosed so that the clearance between the unit and venting to combustible material is visible. Also inspected to manufacturer’s specifications, are the independent emergency key operated shut-off valve and interior and exterior distances to combustibles. Two inspections are required (ref. Residential Gas Appliances & Venting).
Water Heater Replacements – Are inspected by the Technical Services Department on completion of installation for proper venting, gas piping, water line connection, and clearances to combustibles in accordance with NYS Uniform Fire Prevention and Building Code, reference standards, manufacturer’s specifications, and generally accepted practices (ref. Residential Gas Appliances & Venting).
Above Ground Pools – Are inspected by the Technical Services Department on completion of installation for minimum distance to grade and minimum distance to structures and overhead power lines. Documentation of approved electrical inspection should be submitted at this time (ref. Private Swimming Pools).
Inground Pools – Are inspected by the Technical Services Department on completion of installation for proper enclosure such as self-closing, self-latching gates and doors, minimum distance to structures, and overhead power lines. Documentation of approved electrical inspection should be submitted at this time (ref. Private Swimming Pools).
Pool Enclosures – Are inspected by the Technical Services Department for compliance to NYS Building Code regarding minimum heights to grade, self-closing, self-latching devices on gates and openings, construction detail of enclosure (ref. Private Swimming Pools).
Pool Decks – Are inspected by the Technical Services Department on completion of installation for structural support and proper enclosure to pool as per drawing details (ref. Decks & Pool Decks).

Please note that not all of the items listed may apply to your particular business, and that you should refer to the plan review sheet prepared by he Fire Marshal’s Office if you have a specific question.

Fire System Working – Are inspected by the Fire Marshal’s Office for written documentation from contractor that live alarm system, fire/smoke detection system, sprinkler system, etc. was installed in conformity with all applicable code requirements. And that all components are in proper operating condition.
Fire Extinguishers – Are inspected by the Fire Marshal’s Office. Portable fire extinguishers are to be of the appropriate rating and type, mounted in clearly visible and unobstructed locations, and supplied with current inspection tags from a qualified fire extinguisher servicing company.
Aisle Width – Is inspected by the Fire Marshal’s Office. Store fixtures to be arranged so that main aisle to exit doors through sales floor has a minimum of five (5) feet unobstructed width, and secondary aisles leading to main aisles have a minimum of forty four (44) inches unobstructed width.
Grease Trap Certification – Is made by either the manufacturer or a licensed professional for the “as built” device.
Oil Separator Certification – Is made by the manufacturer or a licensed professional.
Sediment Trap Certification – The “as built” installation by the manufacturer or licensed certified engineer.
Licensed Hauler Certification – Applicant must submit to the Technical Services Department a copy of a contract with a hauler holding a New York State solid waste license for all grease and oil separators with a capacity of 500 lbs. or greater.
Interior Finish Certification – Is made by the product manufacturer before final.
Smoke/Fire Detection Certification – By a New York State licensed alarm company before final, and during installation and certified to the Technical Services Department and/or the Fire Marshal’s Office.
Backflow Certification – By New York State Health Department certified tester and licensed design professional with proper Health Department form. Regulations vary. You will be advised at the time of permit application.
Monroe County Septic System Approval Final – By Monroe County Health Department before final.
Carpet Certification – By manufacturer per approved and listed test requirements.
Sprinkler Certification – By installer per N.F.P.A. standards.
Grading – By Department of Public Works. Grading completed as per plan. Includes all covenants and residential agreements with the Town of Greece. If complete, a Certificate of Occupancy will be issued. If grading cannot be completed due to seasonal conditions, a seasonal grading form will be issued.
Instrument Survey Maps – By licensed professional prior to final inspection. Two (2) original copies to be submitted.
Site Plan Compliance – Inspections are performed by Technical Services, per approved minor improvement on site plan, at the time of final. Incomplete items generally require a deposit form provided by the Technical Services Department.
Stop Work Order – Posted by the Technical Services Department for proceeding with an alteration, remodel, or construction of property without proper permits or approvals. A fee and fine may be levied.
Audit – Are performed by the Technical Services Department on commercial construction projects at any time during normal business hours, after permit issuance.

When a permit request indicates that an intended activity or structure will result in a violation of any provision of the Zoning Ordinance, the Building Inspector will deny the permit request. The applicant is then referred to the Zoning Office, where an appeal of the denial (variance) may be requested.
This request for a variance is heard by the Board of Zoning Appeals at a public hearing. This Board has the authority to provide the relief requested, as well as grant special permits for certain regulated activities, such as home occupations.
