Upon initial identification of a code violation, a Code Enforcement Officer will issue either a Verbal Warning or a Notice of Violation through personal contact, posting of the premises and/or by first class mail to the responsible party. The Verbal Warning or Notice of Violation will explain any substantiated violation(s) and corrective action(s) required to be completed immediately or within a designated period of time.
If noted violation(s) are not corrected by the compliance date, a Final Notice of Violation or Administrative Citation will be issued shortly after the designated time period has passed through personal contact, posting of the premises and/or by first class mail to the responsible party. All such Final Notices of Violation will contain strong language, specifying potential recourse, legal actions and costs to be incurred. Administrative Citations, if issued, shall contain all of the information required in Chapter 1.16 of the Lancaster Municipal Code.
If sufficient or timely progress is NOT made by the compliance date or the violator has not entered into an agreement with the City specifying a reasonable timeframe for compliance, officers may pursue other or concurrent options for gaining compliance.
The exact number of days for correction will depend upon the required action for compliance, the severity of the violation and/or potential immediate hazard to the community. It may also vary on a case-by-case basis. A mountain of junk, trash and debris in the yard, or an insufficient landscaping violation may take more time to remedy, for example, than trash cans left at the curb. The Code Enforcement Officer must use discretion in determining reasonable time frames for compliance.
When Verbal Warnings, Notices of Violation and/or Administrative Citations have been issued and voluntary compliance is not achieved, Code Enforcement staff will continue to work for voluntary compliance even while taking necessary steps to legally abate any violation(s). Citizens shall receive all due process and notices, as well as copies of documentation as required by ordinance and upon receipt of written request. (FAQ1371)
